Parties and terms
These Terms of Service and the accompanying Privacy Policy of AnatomyTOOL are collectively identified in this document as: this 'Agreement'.
The AnatomyTOOL platform (http://anatomytool.org) is developed by the Departments of Anatomy & Embryology of the Leiden University Medical Center, Leiden, Netherlands and of the Maastricht University, Faculty of Health, Medicine & Life Science, Maastricht, Netherlands. It is supported by the Dutch Association of Anatomists ('Nederlandse Anatomen Vereniging') that represents the Dutch and Flemish Departments of Anatomy.
These parties are collectively identified in this Agreement as 'the AnatomyTOOL Parties' or 'we', 'us'.
You, the user of the AnatomyTOOL site, are identified in this Agreement as 'you'.
Acceptance of This Agreement
By accessing the AnatomyTOOL website, creating an account on AnatomyTOOL or otherwise using AnatomyTOOL, you acknowledge that you have read, understood and agree to these Terms of Service and the accompanying Privacy Policy of AnatomyTOOL (collectively: 'Agreement'), and any future modifications or additions.
Revisions
We reserve the right to revise and amend this Agreement from time to time in our sole discretion. Any changes to this Agreement will be posted on the AnatomyTOOL website. We will attempt to notify users who log onto AnatomyTOOL of material modifications to this Agreement. However, you should periodically check this Agreement for any modifications. If you do not agree to any modifications to this Agreement, your sole remedy is not to use AnatomyTOOL.
Medical information
The information contained in this site is intended solely for informational and educational purposes, and is not meant to provide medical advice, nor meant to be used for medical diagnosis or treatment. You should consult with a qualified physician for diagnosis and personal medical advice.
User Content
User-content - lawfulness
If you submit Content to AnatomyTOOL you acknowledge that you are entirely responsible for the Content you submit and any consequences resulting thereof. You represent and warrant that you will not upload, post or otherwise transmit any User Content to or through AnatomyTOOL that infringes, misappropriates or otherwise violates any copyright, trademark or other intellectual property right, right of privacy, right of publicity or any other right of any entity or person; or that is unlawful, threatening, libelous, defamatory, obscene, scandalous, pornographic, or profane, or that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law or AnatomyTOOL's rule or policy.
Specifically, by uploading and submitting content on AnatomyTOOL you declare that:
- You have read and understand these Terms of Service and Privacy Policy of AnatomyTOOL, and agree with them.
- Right to publish the material. You have the right to publish this content and to determine its license.
- No copyright infringement. Your submission contains no material that infringes on copyrights. If, in your submission, there are any non-open media or data of which you do not hold the copyright, you have obtained permission from the copyright-holder to publish these media or data openly accessible on the internet under the chosen license.
- No violation of personal rights. If any individuals might be traced from any media or data present in the content you submit, you have a written consent from those individuals to publish these media or data openly accessible on the internet on AnatomyTOOL.
These requirements only apply to content that is under your control and that you publish in relation with AnatomyTOOL: e.g. content that you upload on Anatomy TOOL , content that you post on YouTube and refer to from AnatomyTOOL. These requirements do not apply to content outside your control, such as online content from others to which you hyperlink.
User content - copyright and license
You should license any content you submit on AnatomyTOOL under a Creative Commons license or release it in the Public Domain. This obligation does not apply to students who submit content as part of an assignment. More information about these licenses can be found at https://creativecommons.org/licenses/. If you choose a Creative Commons license, you retain the copyright of your User Content, as Creative Commons licenses are based on copyright. If you release the content in the Public Domain, you abandon all rights in the content.
Display of user content
All content that you submit to AnatomyTOOL, with the exception of student-generated content, will be publicly accessible on AnatomyTOOL, with your name and the name of your institution (if applicable) displayed together with it. This information is shown to credit the author and their institution, and to inhibit submission of inferior quality content.
To enable AnatomyTOOL to display the content, by submitting User Content to AnatomyTOOL, you grant AnatomyTOOL a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, modify, adapt, publish, create derivative works from, distribute, perform, and display such User Content in connection with the Site, subject the terms of our Privacy Policy.
Student-generated content
Material that is uploaded and submitted by a person logged in under a student account is regarded as 'student generated content'. The following holds for such content:
- This material will be regarded as temporary and will be automatically deleted after 16 months.
- Only persons designated by AnatomyTOOL (e.g. admins, teaching staff, your own study group) will be able to view this material.
- If you apply (in the license selector field) a Creative Commons or Public Domain license to this material, the material you submit may be copied and posted permanently under the license you have chosen. If you do not want this, do not choose a Creative Commons or Public Domain license.
User content - review requirement
All content submitted to AnatomyTOOL, with the exception of student-generated content and of content that you choose to keep outside review, must be reviewed.
If you submit content to AnatomyTOOL, you agree to endeavour to have the submitted content reviewed. To this aim, you should invite potential reviewers to review the Content you submitted until it is reviewed positively or you withdraw the Content.
Reviews must be performed by a faculty member of a department of Anatomy of an officially recognized Department of Anatomy of a University or a University of Applied Sciences or a certified health care provider. The reviewer should be knowledgeable about the field of the Content you submitted.
You may request only one potential reviewer at a time.
As long as the content you submitted has not yet received a positive review it will be labelled on AnatomyTOOL as 'To be reviewed' and it will not be accessible, unless the user explicitly requests to view unreviewed material by clicking a button on AnatomyTOOL to this aim.
Content that does not receive a positive review will be automatically deleted 16 months after its submission.
Automatic content removal
Student-generated content and content that has not yet received a positive review will be automatically deleted 16 months after its submission.
Your activities on AnatomyTOOL
User Account
If you create a user account you warrant that: (i) the information you provide to us is accurate and complete; (ii) you will keep your password secure; and (iii) you will notify us of any suspected breach of security or unauthorized use of your account.
Fair use
The usage of AnatomyTOOL by you or by users requested to do so by you (such as students whom you request to use any part of AnatomyTOOL) and the amount of Content submitted by you should not exceed fair use (as determined by us in our sole discretion).
Forbidden activities
You agree:
- Not to take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large burden or load on AnatomyTOOL or its third-party providers’ infrastructure;
- Not to interfere or attempt to interfere with the proper working of AnatomyTOOL or any activities conducted using the Site;
- Not to introduce any malicious software, viruses, worms, or other harmful code onto the website that are designed or intended to disrupt, damage, limit, or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password, or other information of AnatomyTOOL or any third party;
- Not to circumvent any security-related features of the Site.
Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the AnatomyTOOL Parties from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) your use of and access to the AnatomyTOOL Site; (ii) any User Content you post, upload, use, distribute, store or otherwise transmit through the Site; (iii) your violation of any term of this Agreement; or (iv) your violation of any law, rule or regulation, or the rights of any third party.
Reviewers
By reviewing any content on AnatomyTOOL you declare that:
- You are a faculty member of a department of Anatomy or other health care related subject of an officially recognized University or a University of Applied Sciences or a certified health care provider.
- You are sufficiently knowledgeable about the field of the Content you review.
- Your review is impartial.
- You are aware and agree that if you positively review the content (accept it), your review will be publicly displayed on AnatomyTOOL together with your name, function and Institution. This is meant on one hand to credit you as reviewer and on the other hand to ensure quality and impartiality of reviews.
Liabilities
External Links
This site may contain links to other Internet sites. AnatomyTOOL does not control these external sites, the information on these sites is created and maintained by other organizations. AnatomyTOOL is not responsible for the content of these external sites, nor does AnatomyTOOL endorse or warrant any products or services that may be offered at these other Internet sites.
Copyright infringement
If a user has uploaded any Content to AnatomyTOOL that infringes your intellectual property rights, you should send us a request to remove this content, supplying precise information about the alleged infringement and proof of your ownership of the Content and proof of your identity.
Liability
AnatomyTOOL is provided “as is” and “as available.”
You understand and agree that we make no representations or warranties with respect to the site or its content.
We disclaim all warranties, express, implied or statutory as to the accuracy, reliability or completeness of any of the content provided on this site, or as to the fitness of the information for any purpose.
We disclaim all warranties, express, implied or statutory as to the availability and technical quality of this site (security, compatibility, or otherwise).
We disclaim all warranties, express, implied or statutory as to the availability, security and retainment of data you place on AnatomyTOOL.
We do not warrant that the site will be error-free or that defects with the site will be corrected.
In no event shall the AnatomyTOOL Parties be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with the usage of AnatomyTOOL.
Governing Law
This Agreement shall be governed by the laws of the Netherlands.
Privacy Policy
AnatomyTOOL may store information gathered during your usage of this site. AnatomyTOOL and its operators may use this information for the purpose of evaluating the use of AnatomyTOOL, improving and extending the functionality of this site and for compiling reports on usage of this site. No personally identifiable information will be published, or provided to third parties, unless required to do so by law.
When you create an account, we will collect certain personal information such as your name, email address, password and the Institution to which you are affiliated (if applicable). We use this information to validate your identity and to improve the quality of AnatomyTOOL.
If you contribute to AnatomyTOOL by submitting or editing content, your name (and possibly additional details such as your titles) and the name and country of the Institution you are affiliated with, as entered by you, will be published publicly, connected to the content you added or corrected, for the purpose of providing users of this site the opportunity to judge the reliability of the provided content, and of crediting your contribution.
This does not hold for content submitted when logged in as a student. In that case, the content you submit and your user details will only be accessible for people specifically designated by AnatomyTOOL, such as admins, faculty staff and your student group.
However, if you license your student-generated content under a Creative Commons license or place it in the Public Domain, your content may be copied to the public area of AnatomyTOOL. In that case your user details (name, titles, name and country of the affiliated Institution) will be publicly displayed in connection with your content.
We will not publish your email address, unless you explicitly allow us to do so.
